Constitutional amendment creates the Constitutional Tribunal (Art. 33a)

On 26 March 1982, under martial law, the Constitution of the Polish People's Republic was amended to add provisions on a Constitutional Tribunal and a Tribunal of State; the Sejm passed the Tribunal of State Act on the same day. Review of the constitutionality of law, until then a task of the Council of State, passed to the new Tribunal, whose members the Sejm was to elect from among persons distinguished by their legal knowledge (Art. 33a(4)). In 1980–1981 the bar, the Democratic Party (SD), the PZPR and the first national congress of Solidarity had all called for such a court.1,2,3

The Act provided for 12 members (a President, a Vice-President and ten judges) elected and dismissed by the Sejm for eight years, with half the bench renewed every four years, and for an oath before the Marshal of the Sejm. The Sejm considered rulings that statutes were unconstitutional and could reject them by at least a two-thirds majority with at least half of all MPs present (Art. 6(4) of the original text). According to the weekly Polityka (2016), the Act came three years late because the authorities were wary of the new institution.4,5,1

In its resolution of 20 October 1993 (W 6/93), adopted by the full bench on the Ombudsman's application, the Tribunal laid down the interpretation of Art. 7(2) of the Tribunal Act: the Sejm must consider a ruling that a statute is unconstitutional, and if it does not do so within six months the statute loses force when the President of the Tribunal publishes a notice; dissolution of the Sejm and Senate suspends the time limit. Recording inside the Tribunal: the President tells judges “you are not judges”

A recording published at 01:39, described consistently by PAP, RMF24, TVN24 and naTemat, shows the President with State Protection Service officers and Zbigniew Bogucki in a Tribunal corridor; Korwin-Piotrowska says “We are judges of the Constitutional Tribunal”, and Nawrocki tells her, Krystian Markiewicz and Maciej Berek: “You are not judges of the Constitutional Tribunal and you are taking over this building illegally.” Bogucki tells Korwin-Piotrowska “You are committing a coup d'état” and, pointing to Sławomir Patyra, says he sees only one judge; Korwin-Piotrowska replies that she directs the Tribunal. The recording indicates the President was inside the building by 01:39 at the latest.341,342,340,343

Chancellery photo shows President, Kapiński, Bogucki, Grodecki, Sochański inside

A photo published by Rafał Leśkiewicz (WP 02:21, TVN24 02:39) shows Karol Nawrocki, Zbigniew Kapiński, Zbigniew Bogucki, National Security Bureau head Bartosz Grodecki and Tribunal Vice-President Bartłomiej Sochański inside the Tribunal. Spokeswoman W. Ścibor says Sochański is in his office and regards the break orders as “non-existent documents”; both sides of the dispute are thus in the building.338,333,344,345

Szefernaker: Tusk is “bringing thousands of police officers to Warsaw”

According to WP (03:41) and TVN24 (03:56), Paweł Szefernaker of the President's office wrote on X that before All Saints' Day “one man is bringing thousands of police officers to Warsaw” so that Tusk can grab more power, and that the Prime Minister should bear political and legal responsibility. No communiqué confirms the number of officers; media describe Szefernaker's position inconsistently.327,333
